Terms of Service

These Terms of Service ("Terms") govern your use of the GameVox application, website, and related services (collectively, the "Service") operated by GameVox ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using GameVox, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and GameVox.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using GameVox, you represent and warrant that you meet these eligibility requirements.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Your Account

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 Account Responsibilities

You are responsible for all activity that occurs under your account. We reserve the right to disable any account at any time, including if we believe you have violated these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any "junk mail", "chain letter", "spam", or any other similar solicitation
• To impersonate or attempt to impersonate GameVox, a GameVox employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm GameVox or users of the Service
• To harass, abuse, threaten, or incite violence towards any individual or group
• To distribute malware, viruses, or any other malicious code
• To attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
• To collect or store personal data about other users without their consent
• To use the Service for any commercial purpose without our express written consent
• To share content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• To share, upload, distribute, or solicit child sexual abuse material (CSAM) or any content that sexually exploits minors in any way
• To use the Service to groom, solicit, or exploit children or minors for any purpose

5. User Content

5.1 Your Content

The Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, audio, video, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.

5.2 Content Rights

You retain all rights to any User Content you submit, post, or display on or through the Service. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute such content solely for the purpose of providing and improving the Service.

5.3 Content Moderation

We reserve the right, but not the obligation, to monitor, edit, or remove any User Content at our sole discretion, without notice, for any reason, including if we believe such content violates these Terms or is otherwise harmful.

6. Child Safety

GameVox prohibits child sexual abuse material (CSAM) and all forms of child exploitation. Violations result in immediate, permanent account termination and reporting to authorities.

6.1 Prohibited Content

Content that sexually exploits or endangers minors is prohibited. This includes images, video, text, and any other media. Accounts posting such content will be terminated immediately without prior warning.

6.2 Legal Compliance and Reporting

GameVox complies with 18 U.S.C. § 2258A. When we identify apparent child sexual exploitation, we remove the content, disable the account, preserve evidence as required by law, and file a report with the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline. We cooperate with law enforcement investigations.

6.3 Enforcement

Violators will have their accounts permanently terminated. We report account information (IP addresses, device data, and account details) to law enforcement and relevant authorities.

6.4 Reporting

To report content that exploits or endangers a child, email safety@gamevox.com or use the in-app reporting tools. You can also report directly to the NCMEC CyberTipline.

7. Intellectual Property

The Service and its original content, features, and functionality (excluding User Content) are the exclusive property of GameVox and its licensors, protected by copyright and trademark law. The Service incorporates third-party open-source components; attributions and license terms are listed on the Licenses page. You may not use our trademarks or trade dress without prior written consent.

8. Privacy

Our Privacy Policy describes how we collect, use, and share your information. By using the Service, you agree to these practices. We don't sell your data to third parties or use it for advertising.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER GAMEVOX NOR ANY PERSON ASSOCIATED WITH GAMEVOX MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, NEITHER GAMEVOX NOR ANYONE ASSOCIATED WITH GAMEVOX REPRESENTS OR WARRANTS THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GAMEVOX, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

11. Termination

We may terminate or suspend your account at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ends immediately.

To delete your account, stop using the Service or contact us. Provisions that should survive termination (ownership, disclaimers, limitations of liability) remain in effect.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be announced at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance. If you disagree with the new terms, stop using the Service.
